Welcome to Insta Bizmart. By accessing our website and using our services, you agree to comply with and be bound by the following terms and conditions.

1. Service Agreement & Scope

All projects are subject to a formal agreement or proposal outlining the scope, timeline, and deliverables. You can view our general pricing packages for reference. Any additional features outside the agreed scope will be billed separately.

2. Payment Terms, Auto-Renewal & Cancellation

All subscription fees are billed in advance on a recurring basis (monthly or as specified in your service agreement). Unless you cancel in accordance with this section, your subscription will automatically renew at the end of each billing cycle using the payment method on file.

To cancel your subscription, you must notify us in writing via email at info@instabizmart.com or through your client dashboard before your next billing date. Cancellations take effect at the end of the current paid billing period — you will retain access to the services until then.

Setup fees, where applicable, are one-time, non-refundable charges that cover the build, configuration, and onboarding of your account. Failure to pay recurring invoices on time may result in suspension or termination of services. For details on refunds, please review our Refund & Cancellation Policy.

3. Intellectual Property

Upon full payment of all outstanding invoices, all intellectual property rights for custom developed software, websites, and designs are transferred to the client. Insta Bizmart retains the right to use the completed project in our portfolio unless a Non-Disclosure Agreement (NDA) is signed.

4. Limitation of Liability

Insta Bizmart shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of our services.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these terms will be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

6. Service Availability & Acceptable Use

We strive to maintain high availability but do not guarantee that our services will be uninterrupted, error-free, or completely secure. Scheduled maintenance, updates, and external factors beyond our control may cause temporary downtime. You agree to use our services only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, the service by any third party. Prohibited activities include, but are not limited to, sending unsolicited spam, attempting to gain unauthorised access to our systems, uploading malicious code, and using the services to store or transmit unlawful, defamatory, or infringing content. We reserve the right to suspend or terminate access where we believe acceptable use has been breached.

7. Eligibility

By accessing or using our services, you confirm that you are at least 18 years of age and, where you are entering into an agreement on behalf of a business, that you are duly authorised to act as that business's representative and have the legal capacity to bind the business to these Terms. If you do not meet these requirements, you must not access or use our services.

8. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice via email or a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your subscription as described in Section 2.
